Terms and Conditions

1. Agreement

These Terms and Conditions ("Terms") govern your access to and use of the QAClan website, command-line agent, web application, and related services (collectively, the "Service") operated by QAClan ("we", "us", or "our"). By creating an account, installing the agent, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Accounts

You must provide accurate information when creating an account and are responsible for maintaining the confidentiality of your credentials and API keys. You are responsible for all activity that occurs under your account. Notify us immediately at [email protected] of any unauthorized use.

3. Plans, Billing and Payment

QAClan offers a free plan for solo users and paid team plans billed on a recurring (monthly or annual) basis. Prices and plan features are described on our pricing page and may change with notice.

Payment processing is handled by our merchant of record, Paddle.com Market Ltd ("Paddle"). By purchasing a subscription you also agree to Paddle's buyer terms. Subscriptions renew automatically at the end of each billing period unless cancelled. You authorize us and Paddle to charge your payment method for all applicable fees and taxes.

4. Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; your paid features remain available until then. Refund eligibility is described in our Refund Policy.

5. Acceptable Use

You agree not to:

• Use the Service to test systems you do not own or lack authorization to test.
• Upload malware, attempt to disrupt the Service, or bypass its access controls.
• Reverse engineer, resell, or sublicense the Service except as permitted by law.
• Use the Service to violate any applicable law, regulation, or third-party right.

We may suspend or terminate accounts that violate these rules.

6. Your Content

You retain ownership of the test scripts, projects, results, and other content you create or upload ("Customer Data"). You grant us a limited license to host, process, and display Customer Data solely to provide the Service. You are responsible for ensuring Customer Data does not include sensitive information that should not be transmitted to a cloud service.

7. Intellectual Property

The Service, including the QAClan brand, website, documentation, and software (excluding open-source components, which remain under their respective licenses), is owned by QAClan and protected by intellectual property laws. We grant you a non-exclusive, non-transferable right to use the Service in accordance with these Terms.

8. Third-Party Services

The Service integrates with third-party tools (for example, Playwright, Google OAuth, Paddle, and AI analysis providers). Your use of those tools is subject to their own terms. We are not responsible for third-party services.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law, QAClan's aggregate liability for any claim arising out of or relating to the Service is limited to the amount you paid us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages, or for loss of data, profits, or business opportunities.

11. Termination

Either party may terminate the relationship at any time. On termination, your right to access the Service ends. We may retain archived records as required by law. Sections that by their nature should survive (for example, payment, disclaimers, limitation of liability, and governing law) will survive termination.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced on the website or by email. Continued use of the Service after an update constitutes acceptance of the updated Terms.
